Commission to make partition of immovable property

Full Text

Where a preliminary decree for partition has been passed, the Court may, in any case not provided for by section 54, issue a commission to such person as it thinks fit to make the partition or separation according to the rights as declared in such decree.

Plain English Summary

Governs appointment of partition commissioners following a preliminary decree for dividing non-agricultural immovable property (such as residential houses, urban commercial buildings, and non-revenue paying properties) according to declared shares.

Key Legal Elements

  • Condition Precedent: Passing of a valid preliminary decree determining parties' fractional shares.
  • Exclusion of Section 54: Section 54 exclusively governs agricultural estates assessed to revenue (which are partitioned by the Collector); Rule 13 applies to all non-agricultural/urban properties.
  • Mandate of Separation: Commissioner executes the physical division and carving out of separate units.

Practical Note

Partition Practice — Landmark Jurisprudence: 1. Shub Karan Bubna Landmark: In Shub Karan Bubna v. Shashi Bhushan Bubna (2009) 9 SCC 689 and Kata Prashanth v. Kata Srinivas (2024), the Supreme Court emphasized that partition suits do not stand terminated with the preliminary decree; the court must proactively initiate final decree proceedings under Rule 13 without forcing the plaintiff to file separate execution petitions. 2. Civil Court vs. Collector Jurisdiction: If the suit land is non-agricultural, abadi, or converted urban plot, the Civil Court alone appoints the commissioner under Rule 13, and the Collector has no jurisdiction under Section 54.
