Effect of failure to furnish security

(1) In the event of such security not being furnished within the time fixed, the Court shall make an order dismissing the suit unless the plaintiff or plaintiffs are permitted to withdraw therefrom.
(2) Where a suit is dismissed under this rule, the plaintiff may apply for an order to set the dismissal aside and, if it is proved to the satisfaction of the Court that he was prevented by any sufficient cause from furnishing the security within the time allowed, the Court shall set aside the dismissal upon such terms as to security, costs or otherwise as it thinks fit, and shall appoint a day for proceeding with the suit.
(3) The dismissal shall not be set aside unless notice of such application has been served on the defendant.

(1) नियत समय के भीतर ऐसी प्रतिभूति न दी जाने की दशा में, न्यायालय वाद को खारिज (Dismiss) करने का आदेश करेगा जब तक कि वादी या वादियों को उससे वाद वापस लेने की अनुज्ञा न दी जाए।
(2) जहां इस नियम के अधीन कोई वाद खारिज किया जाता है, वहां वादी खारीजी को अपास्त कराने (Set the dismissal aside) के लिए आवेदन कर सकेगा, और यदि न्यायालय के समाधानप्रद रूप में यह साबित हो जाता है कि वह अनुज्ञात समय के भीतर प्रतिभूति देने से किसी पर्याप्त हेतुक (Sufficient cause) से निवारित रहा था, तो न्यायालय प्रतिभूति, खर्चों या अन्यथा जैसी वह उचित समझे ऐसी शर्तों पर खारीजी को अपास्त करेगा और वाद में आगे बढ़ने के लिए दिन नियत करेगा।
