Notice of deposit

Full Text

Notice of the deposit shall be given through the Court by the defendant to the plaintiff, and the amount of the deposit shall (unless the Court otherwise directs) be paid to the plaintiff on his application.

Plain English Summary

Mandates that formal notice of the court deposit must be served on the plaintiff through the court, entitling the plaintiff to immediately withdraw the deposited funds upon simple application without prejudice to the trial of any remaining claim.

Key Legal Elements

  • Mandatory Service Through Court: Deposit remains legally ineffective until formal notice is served.
  • Plaintiff's Withdrawal Right: Plaintiff can withdraw deposited funds on application without waiting for final decree.
  • Trigger for Cessation of Interest: The date of receipt of this notice marks the statutory cut-off for interest under Rule 3.

Practical Note

Ensuring Clean Notice of Deposit: Merely depositing funds into the court treasury does not stop interest. The defendant's counsel MUST simultaneously file an application with process fees praying for formal service of notice of deposit upon the plaintiff or plaintiff's pleader. Procure a court acknowledgment of service to establish the date under Rule 3.
