Application of Order to appeals

Full Text

In the application of this Order to appeals, so far as may be, the word “plaintiff” shall be held to include an appellant, the word “defendant” a respondent, and the word “suit” an appeal.

Plain English Summary

Extends all the provisions of Order XXII to appellate proceedings mutatis mutandis, equating plaintiffs to appellants, defendants to respondents, and suits to appeals.

Key Legal Elements

  • Universal Appellate Application: Rules 1 to 10A govern First and Second Appeals.
  • Abatement of Appeal: Failure to substitute deceased appellant or respondent causes appeal to abate.
  • Indivisible Decree Bar: Death of one respondent without substitution abates entire appeal if decree is joint.

Practical Note

Abatement of Appeals in Joint Decrees: In State of Punjab v. Nathu Ram AIR 1962 SC 89, the Supreme Court established the classic test: where a joint decree was passed in favor of multiple respondents, the failure to substitute the legal representatives of one deceased respondent causes the ENTIRE appeal to abate against all respondents if proceeding against the remaining would result in contradictory decrees.
