Procedure in case of assignment before final order in suit

Full Text

(1) In other cases of an assignment, creation or devolution of any interest during the pendency of a suit, the suit may, by leave of the Court, be continued by or against the person to or upon whom such interest has come or devolved.

(2) The attachment of a decree pending an appeal therefrom shall be deemed to be an interest entitling the person who procured such attachment to the benefit of sub-rule (1).

(1) किसी वाद के लंबित रहने के दौरान किसी हित के समनुदेशन (Assignment), सृजन (Creation) या न्यागमन (Devolution) के अन्य मामलों में, वाद न्यायालय की इजाजत (Leave of the Court) से उस व्यक्ति द्वारा या उसके विरुद्ध चालू रखा जा सकेगा जिसके पास ऐसा हित आया है या जिस पर ऐसा हित संक्रांत हुआ है।

(2) किसी डिक्री से की गई अपील के लंबित रहने के दौरान उस डिक्री की कुर्की ऐसा हित समझी जाएगी जो ऐसी कुर्की कराने वाले व्यक्ति को उप-नियम (1) का लाभ पाने का हकदार बनाती है।
