Resistance or obstruction to possession of immovable property

Full Text

(1) Where the holder of a decree for the possession of immovable property or the purchaser of any such property sold in execution of a decree is resisted or obstructed by any person in obtaining possession of the property, he may make an application to the Court complaining of such resistance or obstruction.

(2) Where any application is made under sub-rule (1), the Court shall proceed to adjudicate upon the application in accordance with the provisions herein contained.

Rajesh (1998) 4 SCC 543: A third-party stranger resisting execution cannot be thrown out without adjudicating his claim under Rule 97 read with Rule 101. Even before physical dispossession, an independent third party claiming bona fide title can approach the court to resist warrant execution. 2. Bar on Independent Suits: The stranger does not need to file a separate declaratory suit; the executing court itself must frame issues, record evidence, and decide title finally (Sameer Singh v. Abdul Rab (2015) 1 SCC 379).

(1) जहां स्थावर संपत्ति के कब्जे की डिक्री का धारक अथवा डिक्री के निष्पादन में बेची गई ऐसी संपत्ति का क्रेता संपत्ति का कब्जा प्राप्त करने में किसी भी व्यक्ति द्वारा प्रतिरोधित या बाधित (Resisted or obstructed) किया जाता है, वहां वह ऐसे प्रतिरोध या बाधा की शिकायत करते हुए न्यायालय को आवेदन कर सकेगा।

(2) जहां उप-नियम (1) के अधीन कोई आवेदन किया जाता है, वहां न्यायालय इसमें अंतर्विष्ट उपबंधों के अनुसार उस आवेदन का न्यायनिर्णयन (Adjudicate) करने के लिए अग्रसर होगा।
