Adjournment or stoppage of sale
Full Text
(1) The Court may, in its discretion, adjourn any sale hereunder to a specified day and hour, and the officer conducting any such sale may in his discretion adjourn the sale, recording his reasons for such adjournment: Provided that, where the sale is made in, or within the precincts of, the court-house, no such adjournment shall be made without the leave of the Court.
(2) Where a sale is adjourned under sub-rule (1) for a longer period than thirty days, a fresh proclamation under rule 67 shall be made, unless the judgment-debtor consents to waive it.
(3) Every sale shall be stopped if, before the lot is knocked down, the debt and costs (including the costs of the sale) are tendered to the officer conducting the sale, or proof is given to his satisfaction that the amount of such debt and costs has been paid into the Court which ordered the sale.
Plain English Summary
Regulates adjournment and stoppage of execution sales: mandates a fresh proclamation if sale is adjourned beyond 30 days, and compels immediate cessation of the auction if the decretal amount and costs are tendered before the lot is knocked down.
Key Legal Elements
- Discretionary Adjournment: Court or bailiff may postpone auction for recorded reasons.
- Thirty-Day Fresh Proclamation Rule (Sub-rule 2): Re-advertisement mandatory if postponement exceeds 30 days unless waived.
- Absolute Right to Stop Sale (Sub-rule 3): Debtor can halt auction any second before the hammer falls by tendering debt + costs.
- Knocked Down Cut-off: Once lot is knocked down to highest bidder, debtor loses the right to stop under Rule 69.
Practical Note
Stopping Auction at the 11th Hour: 1. Tendering Debt Before Hammer Falls: Under Rule 69(3), the judgment-debtor has the absolute right to abort the auction up to the precise second the auctioneer knocks down the gavel. Take cash/demand draft of the decretal debt plus Nazir commission directly to the auctioneer at the auction site. 2. Fresh Proclamation Requirement - Shyam Singh v. Collector, Hamirpur (1993) Supp (1) SCC 693: If the court adjourns the sale for more than 30 days and fails to issue a fresh proclamation, the re-auction is fatally flawed.
