Mode of making proclamation
Full Text
(1) Every proclamation shall be made and published, as nearly as may be, in the manner prescribed by rule 54, sub-rule (2).
(2) Where the Court so directs, such proclamation shall also be published in the Official Gazette or in a local newspaper, or in both, and the costs of such publication shall be deemed to be costs of the sale.
(3) Where property is divided into lots for the purpose of being sold separately, it shall not be necessary to make a separate proclamation for each lot, unless proper notice of the sale cannot, in the opinion of the Court, otherwise be given.
Plain English Summary
Prescribes the mandatory mode of publishing the sale proclamation via beat of drum and local affixation under Rule 54(2), permitting additional newspaper and gazette advertisements at the court's discretion.
Key Legal Elements
- Rule 54(2) Procedure: Drum proclamation + affixation on property, court-house, and local revenue offices.
- Newspaper Publication Discretion (Sub-rule 2): Court may order print advertising in widely circulated local dailies.
- Costs Treated as Sale Expenses: Advertising charges recoverable as priority execution costs.
- Multiple Lots Integration (Sub-rule 3): Single omnibus proclamation valid for multiple lots.
Practical Note
Ensuring Clean Newspaper Advertising: In commercial property sales, always pray for publication in a widely circulated vernacular newspaper and an English daily under Rule 67(2). File the full newspaper tear-sheet (with date and masthead intact) into court; clippings alone are routinely objected to.
