[Saving of suits to establish right to attached property.]—Omitted by the Code of Civil Procedure (Amendment) Act, 1976 (104 of 1976), s. 72 (w.e.f. 1-2-1977).

Plain English Summary

Rule 63, which historically allowed an aggrieved party to file a separate title suit within one year of a summary attachment order, was repealed by the 1976 CPC Amendment to bar multiplicity of proceedings and make Rule 58 adjudications conclusive.

Key Legal Elements

  • Historical Right of Separate Suit: Old law allowed a fresh suit under Section 9 / Article 98 Limitation Act within 1 year.
  • Abolished by Act 104 of 1976: Replaced by the absolute bar on separate suits in Rule 58(2).
  • Conclusive Decree Status: Any title grievance must be pursued via appeal under Rule 58(4).

Practical Note

Total Abolition of the 'Rule 63 Suit': Lawyers must never file a fresh title suit challenging an attachment order. Any fresh suit will be dismissed in limine under Order VII Rule 11(d) CPC read with Rule 58(2). The only permissible remedy is an Appeal under Section 96 CPC read with Rule 58(4).
