Appeals

Full Text

An order made under rule 46B, rule 46C or rule 46E shall be appealable as a decree.

Plain English Summary

Accords the status of an appealable decree to orders passed against a garnishee (Rule 46B), determinations of disputed liability (Rule 46C), and adjudications of third-party claims (Rule 46E).

Key Legal Elements

  • Deemed Decree Appealability: Appeal lies under Section 96 CPC as a First Appeal.
  • Orders Covered: Rule 46B (default order), Rule 46C (trial of disputed liability), Rule 46E (third-party rights).
  • Substantive Appellate Remedy: Full review on questions of both fact and law.

Practical Note

Remedy Against Garnishee Orders: Because orders under Rules 46B, 46C, and 46E are deemed decrees under Rule 46H, no revision petition lies under Section 115 CPC. An aggrieved garnishee or decree-holder must file a regular First Appeal under Section 96 with ad valorem court fees.
