Decree for payment of money

Full Text

Every decree for the payment of money, including a decree for the payment of money as the alternative to some other relief, may be executed by the detention in the civil prison of the judgment-debtor, or by the attachment and sale of his property, or by both.

Plain English Summary

Prescribes the two fundamental statutory modes for executing money decrees: civil imprisonment of the judgment-debtor, attachment and auction sale of the debtor's property, or both simultaneously.

Key Legal Elements

  • Primary Modes of Money Execution: (1) Civil detention; (2) Attachment & sale of assets; (3) Cumulative use of both.
  • Alternative Relief Decrees Covered: Applies equally where damages/money are awarded in lieu of specific relief.
  • Constitutional Limitation: Civil detention is subject to Section 51 CPC and Article 21 (Jolly George Varghese doctrine).

Practical Note

Simultaneous Execution vs. Constitutional Safeguards: 1. Simultaneous Execution: The decree-holder has the initial choice of mode under Rule 30, and the court can permit attachment as well as arrest concurrently (Order XXI Rule 21 discretion). 2. Constitutional Filter - Jolly George Varghese v. Bank of Cochin (1980) 2 SCC 360: The Supreme Court held that simple inability to pay does not justify civil imprisonment under Article 21 of the Constitution. Civil detention under Rule 30 is strictly governed by the conditions of Section 51 proviso (proof of means + dishonest evasion/mala fide refusal).
