Section O21R23PopularProcedural

Procedure after issue of notice

Full Text

(1) Where the person to whom notice is issued under rule 22 does not appear or does not show cause to the satisfaction of the Court why the decree should not be executed, the Court shall order the decree to be executed.

(2) Where such person offers any objection to the execution of the decree, the Court shall consider such objection and make such order as it thinks fit.

Plain English Summary

Directs the court to issue execution process where the judgment-debtor defaults or fails to show cause following a Rule 22 notice, or to adjudicate any filed objections.

Key Legal Elements

  • Default Order (Sub-rule 1): Immediate issuance of warrant if debtor defaults.
  • Constructive Res Judicata: Debtor failing to raise objections after Rule 22 notice is barred from raising them at later stages.
  • Adjudication of Objections (Sub-rule 2): Governed by Section 47 CPC.

Practical Note

Constructive Res Judicata in Execution: 1. Landmark Ruling - Mohanlal Goenka v. Benoy Kishna Mukherjee (AIR 1953 SC 65): The Supreme Court established that the principle of constructive res judicata applies to execution proceedings. If a judgment-debtor receives a Rule 22 notice and fails to appear or object, an order passed under Rule 23(1) directing execution precludes the debtor from later raising objections regarding executability or limitation! 2. Advice to Debtor: Never ignore a Rule 22 notice; file objections under Rule 23(2) at the very first appearance.
