Execution in case of cross-claims under same decree

Full Text

Where application is made to a Court for the execution of a decree under which two parties are entitled to recover sums of money from each other, then—
(a) if the two sums are equal, satisfaction for both shall be entered upon the decree; and
(b) if the two sums are unequal, execution may be taken out only by the party entitled to the larger sum and for so much only as remains after deducting the smaller sum, and satisfaction for the smaller sum shall be entered upon the decree.

Plain English Summary

Applies the principle of automatic set-off to cross-claims for monetary recovery arising under the very same decree (e.g. claim vs. counter-claim or costs adjustments).

Key Legal Elements

  • Single Decree Application: Operates within one composite decree.
  • Automatic Mutual Adjustment: Satisfaction entered for overlapping amounts.

Practical Note

Execution after Counter-Claim: Where the decree awards ₹8 lakhs to plaintiff on plaint and ₹3 lakhs to defendant on counter-claim, execution can only be taken out by plaintiff for the net ₹5 lakhs under Rule 19.
