Decree for recovery of immovable property
Full Text
Where the subject-matter of the suit is immovable property, the decree shall contain a description of such property sufficient to identify the same, and where such property can be identified by boundaries or by numbers in a record of settlement or survey, the decree shall specify such boundaries or numbers.
Plain English Summary
Requires decrees for immovable property to contain precise, identifiable descriptions—including boundaries, survey numbers, and settlement records—to prevent ambiguity during execution.
Key Legal Elements
- Sufficiency of Identification: Prevents execution bailiffs from executing against wrong land parcels.
- Boundaries & Survey Numbers: Exact boundary demarcation (East, West, North, South) and settlement numbers.
Practical Note
Executing Property Decrees: If the decree lacks four-sided boundaries, the executing court will face objections under Section 47 CPC that the property is unidentifiable. Ensure the plaint schedule of property complies with Order VII Rule 3 so the decree incorporates it verbatim under Rule 9.
