Contents of decree

Full Text

(1) The decree shall agree with the judgment; it shall contain the number of the suit, the names and descriptions of the parties, their registered addresses, and particulars of the claim, and shall specify clearly the relief granted or other determination of the suit.

(2) The decree shall also state the amount of costs incurred in the suit, and by whom or out of what property and in what proportions such costs are to be paid.

(3) The Court may direct that the costs payable to one party by the other shall be set off against any sum which is admitted or found to be due from the former to the latter.

Plain English Summary

Specifies that the formal decree must perfectly agree with the judgment, clearly setting out suit particulars, registered addresses, precise operative reliefs granted, and the itemized allocation of litigation costs and set-offs.

Key Legal Elements

  • Decree Follows Judgment: Strict requirement of total harmony between reasons and operative decree.
  • Core Contents: Suit number, party details, registered address, and exact relief.
  • Itemized Costs Allocation (Sub-rule 2): Court fees, pleader fees, process fees, and witness expenses.
  • Costs Set-off (Sub-rule 3): Mutual adjustment of payable amounts.

Practical Note

Rectifying Inconsistencies between Judgment and Decree: 1. Common Court Error: Where the trial judge decrees the suit for ₹10 lakhs with 12% interest in the judgment, but the decree-writer inadvertently writes 6% interest or omits costs, the decree conflicts with the judgment. 2. Remedy: File an 'Application under Section 152 read with Order XX Rule 6 CPC for amendment of decree to bring it in conformity with the judgment dated [Date]'.
