Full Text

(1) Where the defendant has been allowed a set-off or counter-claim against the claim of the plaintiff, the decree shall state what amount is due to the plaintiff and what amount is due to the defendant, and shall be for the recovery of any sum which appears to be due to either party.

(2) Appeal from decree relating to set-off or counter-claim.—Any decree passed in a suit in which a set-off or counter-claim is claimed shall be subject to the same provisions in respect of appeal to which it would have been subject if no set-off or counter-claim had been claimed.

(3) The provisions of this rule shall apply whether the set-off is admissible under rule 6 of Order VIII or otherwise.

Plain English Summary

Regulates decrees in suits involving set-off or counter-claim, requiring explicit specification of mutual debts and enabling net recovery in favour of either party, preserving identical rights of appeal.

Key Legal Elements

  • Net Amount Formulation: Declares plaintiff's dues vs. defendant's dues, awarding decree for net balance.
  • Executable by Either Party: If counter-claim exceeds plaint claim, decree is executable by defendant.
  • Appeals Continuity (Sub-rule 2): Governed by standard first appeal rules under Section 96 CPC.

Practical Note

Counter-Claim Execution Nuance: When a defendant succeeds on a counter-claim of ₹20 lakhs against the plaintiff's suit of ₹5 lakhs, the decree will be drawn for ₹15 lakhs in favour of the defendant. The defendant becomes the decree-holder under Order XX Rule 19 and can immediately proceed with execution against the plaintiff under Order XXI.
