Decree may direct payment by instalments
Full Text
(1) Where and in so far as a decree is for the payment of money, the Court may for any sufficient reason incorporate in the decree, after hearing such of the parties who had appeared personally or by pleader at the last hearing, before judgment, an order that payment of the amount decreed shall be postponed or shall be made by instalments, with or without interest, notwithstanding anything contained in the contract under which the money is payable.
(2) Order, after decree, for payment by instalments.—After the passing of any such decree the Court may, on the application of the judgment-debtor and with the consent of the decree-holder, order that payment of the amount decreed shall be postponed or shall be made by instalments on such terms as to the payment of interest, the attachment of the property of the judgment-debtor, or the taking of security from him, or otherwise, as it thinks fit.
Plain English Summary
Authorizes the court to order payment of a money decree in instalments or postpone payment: unilaterally in the original decree for sufficient reason, or post-decree strictly with the decree-holder's consent.
Key Legal Elements
- Pre-Decree Power (Sub-rule 1): Discretionary judicial power to grant instalments overriding contractual terms.
- Post-Decree Power (Sub-rule 2): Absolute condition of DECREE-HOLDER'S CONSENT.
- Security and Interest Terms: Court can attach assets or take sureties to secure instalments.
Practical Note
Resisting Post-Decree Instalment Applications: 1. Absolute Bar without Consent: Judgment-debtors frequently move applications under Order XX Rule 11(2) CPC seeking easy monthly instalments citing financial hardship. The decree-holder can simply state: 'The decree-holder refuses consent; under Rule 11(2), the Court has no jurisdiction to grant instalments without decree-holder's consent'. 2. Supreme Court Precedent: Reaffirmed that post-decree instalments cannot be forced upon an unwilling decree-holder.
