Where there are several issues, the burden of proving some of which lies on the other party, the party beginning may, at his option, either produce his evidence on those issues or reserve it by way of answer to the evidence produced by the other party; and, in the latter case, the party beginning may produce evidence on those issues after the other party has produced all his evidence, and the other party may then reply specially on the evidence so produced by the party beginning; but the party beginning will then be entitled to reply generally on the whole case.

Amarjit Singh (AIR 2005 P&H 207): The Full Bench held that reservation of the right to lead evidence in rebuttal under Rule 3 MUST be exercised and recorded by the Court at the time the plaintiff closes affirmative evidence. If the plaintiff closes evidence in affirmative without reserving rebuttal, they cannot lead rebuttal evidence later. 2. Courtroom Endorsement: When closing evidence, counsel must ensure the statement reads: 'Plaintiff closes affirmative evidence, reserving right to lead evidence in rebuttal on Issue Nos. 3, 4 and 5'.

जहां अनेक विवाद्यक (Several issues) हैं, जिनमें से कुछ को साबित करने का भार दूसरे पक्षकार पर है, वहां प्रारंभ करने वाला पक्षकार अपने विकल्प पर या तो उन विवाद्यकों पर अपना साक्ष्य पेश कर सकेगा अथवा दूसरे पक्षकार द्वारा पेश किए गए साक्ष्य के उत्तर के रूप में उसे आरक्षित (Reserve) रख सकेगा; और पश्चातवर्ती दशा में, प्रारंभ करने वाला पक्षकार उन विवाद्यकों पर अपना साक्ष्य तब पेश कर सकेगा जब दूसरा पक्षकार अपना सारा साक्ष्य पेश कर चुका हो, और दूसरा पक्षकार तब इस प्रकार पेश किए गए साक्ष्य पर विशेष उत्तर दे सकेगा; किन्तु प्रारंभ करने वाला पक्षकार तब संपूर्ण मामले पर साधारणतया उत्तर देने का हकदार होगा।
