When they may depart

Full Text

(1) A person so summoned and attending shall, unless the Court otherwise directs, attend at each hearing until the suit has been disposed of.

(2) On the application of either party and the payment through the Court of all necessary expenses (if any), the Court may require any person so summoned and attending to furnish security to attend at the next or any other hearing or until the suit is disposed of and, in default of his furnishing such security, may order him to be detained in the civil prison.

Plain English Summary

Requires attending witnesses to remain present until formally discharged or case disposal, and authorizes the court to demand security for future attendance on pain of civil imprisonment.

Key Legal Elements

  • Continuous Attendance Obligation: Witnesses cannot leave without judicial permission.
  • Security for Future Appearance (Sub-rule 2): Granted upon party application and deposit of expenses.
  • Detention in Civil Prison: Ultimate coercive sanction for refusing to furnish appearance security.

Practical Note

Bound Down Witnesses: When an outstation witness's evidence is half-recorded and the clock strikes 4:00 PM, counsel must request the Judge: 'May the witness be bound down to appear tomorrow at 10:30 AM under Order XVI Rule 16 CPC without fresh summons'.
