Full Text

In fixing dates or setting time limits for the purposes of Rule 2 of this Order, the Court shall ensure that the arguments are closed not later than six months from the date of the first Case Management Hearing.

Plain English Summary

Imposes a mandatory statutory ceiling on commercial trials, commanding that all evidence, written submissions, and oral arguments must be concluded not later than six months from the date of the first Case Management Hearing.

Key Legal Elements

  • Inflexible 6-Month Statutory Window: Core objective of the Commercial Courts Act, 2015 to prevent protracted litigation.
  • Inclusive of Trial and Arguments: Covers witness examination, cross-examination, and final oral arguments.
  • Judicial Accountability: Commercial courts are required to submit quarterly compliance reports to the High Court Commercial Division.

Practical Note

The 6-Month Trial Mandate in Commercial Practice: 1. Supreme Court Landmark - Ambalal Sarabhai Enterprises Ltd. v. KS Infraspace LLP (2020) 15 SCC 158: The Supreme Court emphasized that the purpose of the Commercial Courts Act is the expeditious resolution of commercial disputes. The 6-month trial timeframe under Order XV-A Rule 3 must be strictly respected by trial courts and litigating parties. 2. Strategy: When the adversary seeks frivolous adjournments during evidence, invoke Rule 3: 'This Hon'ble Court is bound by the 6-month statutory mandate under Order XV-A Rule 3 CPC; the trial must conclude on a day-to-day basis'.
