Rejection of irrelevant or inadmissible documents

Full Text

The Court may at any stage of the suit reject any document which it considers irrelevant or otherwise inadmissible, recording the grounds of such rejection.

Plain English Summary

Authorizes the court at any stage of the suit to reject and discard documents deemed irrelevant or legally inadmissible, mandating that the specific grounds of rejection be recorded in the order sheet.

Key Legal Elements

  • Plenary Jurisdiction at Any Stage: Operates before, during, or after evidence.
  • Two Disqualification Grounds: (1) Irrelevancy under law of evidence; (2) Inadmissibility (e.g. bar under Registration Act or Stamp Act).
  • Mandatory Recording of Reasons: Judge must write an articulate speaking order explaining rejection.

Practical Note

Objecting to Inadmissible Documents: If the adversary seeks to tender an unregistered partition deed or unstamped lease deed requiring compulsory registration under Section 17 Registration Act, raise an objection under Order XIII Rule 3 praying that the document be rejected and discarded from evidence at the threshold.
