Full Text

(1) The Court may of its own motion, and may in its discretion upon the application of any of the parties to a suit, send for, either from its own records or from any other Court, the record of any other suit or proceeding, and inspect the same.

(2) Every application made under this rule shall (unless the Court otherwise directs) be supported by an affidavit showing how the record is material to the suit in which the application is made, and that the applicant cannot without unreasonable delay or expense obtain a duly authenticated copy of the record or of such portion thereof as the applicant requires, or that the production of the original is necessary for the purposes of justice.

(3) Nothing contained in this rule shall be deemed to enable the Court to use in evidence any document which under the law of evidence would be inadmissible in the suit.

Plain English Summary

Empowers the court suo motu or on application supported by affidavit to requisition and inspect records of other judicial proceedings from its own registry or other courts, subject to strict materiality and the law of evidence.

Key Legal Elements

  • Requisition of Judicial Records: Power to requisition files from record rooms or coordinate/subordinate courts.
  • Mandatory Supporting Affidavit (Sub-rule 2): Must substantiate: (i) materiality to present suit, (ii) why certified copies cannot be obtained without delay/expense, and (iii) necessity of original.
  • Inspection vs Evidence (Sub-rule 3): Mere requisition of a record file does not automatically make its contents evidence; specific documents must still be formally tendered and proved under the Evidence Act.

Practical Note

Requisitioning Case Files from Other Courts: 1. Requisite Grounds in Affidavit: The court will dismiss a Rule 10 application if you merely want to avoid applying for certified copies. The applicant MUST show why the physical original file is needed (e.g. to compare original disputed signatures with court pleadings, or because the record room certified that copies cannot be issued). 2. Application Header: 'Application on behalf of Plaintiff under Order XIII Rule 10 read with Section 151 CPC for Requisitioning the Judicial Record of Civil Suit No. 123 of 2015 titled A v. B from the Record Room / Court of Civil Judge'.
