Notice to admit facts

Full Text

Any party, may, by notice in writing, at any time not later than nine days before the day fixed for the hearing, call on any other party to admit, for the purposes of the suit only, any specific fact or facts, mentioned in such notice. And in case of refusal or neglect to admit the same within six days after service of such notice, or within such further time as may be allowed by the Court, the costs of proving such fact or facts shall be paid by the party so neglecting or refusing, whatever the result of the suit may be, unless the Court otherwise directs:

Provided that any admission made in pursuance of such notice is to be deemed to be made only for the purposes of the particular suit, and not as an admission to be used against the party on any other occasion or in favour of any person other than the party giving the notice.

कोई भी पक्षकार, सुनवाई के लिए नियत दिन से नौ दिन (9 Days) से अन्यून पूर्व किसी भी समय लिखित सूचना द्वारा किसी अन्य पक्षकार से यह अपेक्षा कर सकेगा कि वह केवल उस वाद के प्रयोजनों के लिए, ऐसी सूचना में उल्लिखित किसी विनिर्दिष्ट तथ्य या तथ्यों को स्वीकार करे। और ऐसी सूचना की तामील के पश्चात छह दिन (6 Days) के भीतर, अथवा ऐसे अतिरिक्त समय के भीतर जैसा न्यायालय अनुज्ञात करे, उसे स्वीकार करने में इनकार या उपेक्षा की दशा में, ऐसे तथ्य या तथ्यों को साबित करने का खर्चा, वाद का परिणाम चाहे कुछ भी हो, उस प्रकार उपेक्षा या इनकार करने वाले पक्षकार द्वारा संदत्त किया जाएगा, जब तक कि न्यायालय अन्यथा निदेश न दे:

परन्तु ऐसी सूचना के अनुसरण में की गई कोई भी स्वीकृति केवल उसी विशिष्ट वाद के प्रयोजनों के लिए की गई समझी जाएगी, और किसी अन्य अवसर पर अथवा सूचना देने वाले पक्षकार से भिन्न किसी व्यक्ति के पक्ष में उपयोग किए जाने वाली स्वीकृति नहीं होगी।
