Notice to admit documents

Full Text

Either party may call upon the other party to admit, within seven days from the date of service of the notice any document, saving all exceptions; and in case of refusal or neglect to admit, after such notice, the costs of proving any such document shall be paid by the party so neglecting or refusing, whatever the result of the suit may be, unless the Court otherwise directs; and no costs of proving any document shall be allowed unless such notice is given, except where the omission to give the notice is, in the opinion of the Court, a saving of expense.

Plain English Summary

Enables either party to serve a 7-day notice calling upon the adversary to admit any document, imposing the costs of formally proving the document on the refusing party regardless of the final suit outcome.

Key Legal Elements

  • 7-Day Notice Timeline: Reduced from 15 days to 7 days by 1976 CPC Amendment.
  • Saving All Exceptions: Admission of execution/authenticity does not waive legal objections to relevance or admissibility (e.g. stamp duty bar).
  • Cost Sanction Independent of Outcome: Refusing party pays proving costs even if they ultimately win the suit.
  • Condition Precedent for Document Proving Costs: Proving costs disallowed if plaintiff failed to serve Rule 2 notice without valid excuse.

Practical Note

Cost Penalty Strategy under Rule 2: Before summoning bank managers or hand-writing experts at huge expense, serve notice under Order XII Rule 2. If the defendant unreasonably refuses to admit the signature, the court will direct the defendant to pay all expert witness allowances regardless of who wins.
