Application for discovery of documents
Full Text
Any party may, without filing any affidavit, apply to the Court for an order directing any other party to any suit to make discovery on oaths, of the documents which are or have been in his possession or power, relating to any matter in question therein. On the hearing of such application the Court may either refuse or adjourn the same, if satisfied that such discovery is not necessary, or not necessary at that stage of the suit, or make such order, either generally or limited to certain classes of documents, as may, in its discretion be thought fit: Provided that discovery shall not be ordered when and so far as the Court shall be of opinion that it is not necessary either for disposing fairly of the suit or for saving costs.

कोई भी पक्षकार, बिना कोई शपथपत्र दाखिल किए, न्यायालय को ऐसे आदेश के लिए आवेदन कर सकेगा जिसमें किसी वाद के किसी अन्य पक्षकार को यह निदेश दिया जाए कि वह उन दस्तावेजों का शपथ पर प्रकटीकरण (Discovery on oath) करे जो उसमें के किसी विवादग्रस्त विषय से संबंधित उसके कब्जे या शक्ति में हैं या रहे हैं। ऐसे आवेदन की सुनवाई पर न्यायालय, यदि उसका यह समाधान हो जाता है कि ऐसा प्रकटीकरण आवश्यक नहीं है या वाद के उस प्रक्रम पर आवश्यक नहीं है, तो उसे या तो नामंजूर कर सकेगा या स्थगित कर सकेगा, अथवा ऐसा आदेश या तो साधारणतया या दस्तावेजों के कतिपय वर्गों तक सीमित करते हुए कर सकेगा, जैसा उसके स्वविवेक में ठीक समझा जाए: परन्तु प्रकटीकरण का आदेश तब और उस सीमा तक नहीं किया जाएगा जब और जिस सीमा तक न्यायालय की यह राय हो कि वह या तो वाद के ऋजु निपटारे के लिए अथवा खर्चे की बचत के लिए आवश्यक नहीं है।
