Plain English Summary
Section 92 governs representative suits for public religious and charitable trusts, empowering the Advocate-General or two or more interested persons with leave of the District Court to seek trustee removal, appointment, scheme framing, accounts, and application of trust funds under the cy-près doctrine.
Key Legal Elements
- Subject-Matter: Express or constructive trust created for public purposes of a religious or charitable nature.
- Jurisdiction: Principal Civil Court of original jurisdiction (District Court) where any part of trust property is situated.
- Authorized Plaintiffs: Advocate-General, or two or more persons having a real/direct interest who obtain leave of the court.
- Specified Reliefs (Clauses a to h): Removal/appointment of trustees, vesting property, possession from ousted trustees, accounting, scheme settlement.
- Mandatory Exclusivity (Sec 92(2)): No suit claiming any specified reliefs against a public trust is maintainable without complying with Section 92.
- Cy-près Doctrine (Sec 92(3)): Court's statutory power to alter original trust objects and divert funds to analogous charitable purposes when original objects fail or become obsolete.
Practical Note
Public Trust Scheme Suits, Leave Threshold & Cy-près Doctrine: (1) Condition Precedent — Leave of the Court: In *R.M. Narayana Chettiar v. N. Lakshmanan Chettiar (1991)*, the Supreme Court established that obtaining leave of the court is a condition precedent to prevent vexatious suits against bona fide trustees. Notice to proposed defendants before granting leave is desirable though not strictly mandatory. (2) 'Persons Having an Interest': Plaintiffs must have a direct, substantial, and real interest in the trust (e.g. regular devotees, beneficiaries, or community members), not merely remote, casual, or vindictive interest. (3) Public vs Private Trusts: Section 92 does not apply to private family trusts or private debutter endowments; if a trust is private, an ordinary civil suit lies under Section 9 without Section 92 leave. (4) Recovery against Strangers / Trespassers: In *Bishwanath v. Radha Ballabhji (1967)*, the Supreme Court held that a suit to recover trust property from a third-party trespasser or stranger does not fall under Section 92; it is a regular title suit. (5) Cy-près Doctrine (Sec 92(3)): Enables courts to re-allocate obsolete, surplus, or impossible endowments to proximate charitable causes without allowing funds to lapse.
