Power to state case for opinion of Court
Full Text
Where any persons agree in writing to state a case for the opinion of the Court, then the Court shall try and determine the same in the manner prescribed.
Plain English Summary
Section 90 empowers parties having a bona fide dispute on questions of law or fact to mutually submit an agreed stated case in writing for the determination and binding opinion of the Court in accordance with Order XXXVI.
Key Legal Elements
- Written Agreement: Mutual, unequivocal agreement in writing between all disputing parties.
- Statement of Case: Parties draw up agreed facts and specific questions of law or construction.
- Order XXXVI Regulation: Prescribed procedure under Order XXXVI (Special Case) governs filing, hearing, and decree.
- Bona Fide Controversy: Must involve a real and substantial interest, not a moot, speculative, or collusive query.
Practical Note
Special Case Procedure & Order XXXVI Practice: (1) Friendly Suits (Order XXXVI): Section 90 is the substantive anchor for 'Special Case' or friendly suits regulated by Order XXXVI. Parties bypass lengthy formal pleadings and trial by directly framing agreed questions of law or construction of documents. (2) Mandatory Conditions: Under Order XXXVI Rule 1 & 3, the agreement must be in writing, signed by all parties, certified to be a bona fide dispute with real pecuniary interest, not hypothetical, and the property/money in question must be placed at the disposal of the court. (3) Non-Appealable Consent Judgment: A decree pronounced under Section 90 / Order XXXVI Rule 5 operates on the basis of mutual consent and finality; no ordinary appeal lies against such determination, except on grounds of fraud or absence of jurisdiction.
