Section 88PopularProcedural

Where interpleader suit may be instituted

Full Text

Where two or more persons claim adversely to one another the same debts, sum of money or other property, movable or immovable, from another person, who claims no interest therein other than for charges or costs and who is ready to pay or deliver it to the rightful claimant, such other person may institute a suit of interpleader against all the claimants for the purpose of obtaining a decision as to the person to whom the payment or delivery shall be made and of obtaining indemnity for himself:

Provided that where any suit is pending in which the rights of all parties can properly be decided, no such suit of interpleader shall be instituted.

Plain English Summary

Section 88 empowers a neutral stakeholder or debtor holding property or money with no beneficial interest (except costs/charges) to institute an interpleader suit against rival adverse claimants to judicially determine rightful ownership and obtain statutory indemnity, provided no pending suit already allows proper adjudication of all claims.

Key Legal Elements

  • Competing Adverse Claimants: Two or more rival parties claiming the exact same debt, money, or movable/immovable property.
  • Disinterested Stakeholder: Plaintiff must possess no beneficial interest in the subject-matter other than legitimate charges or costs.
  • Willingness to Deliver/Deposit: Plaintiff must be ready and willing to pay, deliver, or deposit the property into court custody (Order XXXV Rule 2).
  • Discharge and Indemnity: Primary objective is to determine rightful recipient and grant complete legal indemnity/discharge to the plaintiff stakeholder.
  • Statutory Proviso Bar: An interpleader suit cannot be instituted if another pending suit already affords complete adjudication of all parties' rights.

Practical Note

Interpleader Suit Dynamics, Order XXXV Rules & Bank/Bailee Practice: (1) Procedural Code with Order XXXV: Section 88 is the substantive power, while Order XXXV provides the procedure. Under Order XXXV Rule 1, the plaint must specifically state that the plaintiff claims no interest other than charges/costs, that there is no collusion with any defendant, and plaintiff must deposit the money/property into court under Rule 2. (2) Agents & Tenants Barred (Order XXXV Rule 5): An agent cannot institute an interpleader suit against their principal, nor can a tenant sue their landlord to compel interpleading with third-party adverse claimants, unless claiming under the landlord. (3) Disinterestedness is Inviolable: If the plaintiff contests liability, asserts a personal stake, or colludes with one claimant, the interpleader suit fails. (4) Proviso Bar: If one claimant has already filed a regular recovery/title suit where other rival claimants can be impleaded under Order I Rule 10, an interpleader suit is barred by the proviso.
