Plain English Summary
Section 7 specifies provisions of the CPC that do not extend to Provincial Small Cause Courts, notably barring them from executing decrees against immovable property, issuing injunctions, appointing receivers for immovable property, and entertaining regular appeals or revisions under the Code.
Key Legal Elements
- Statutory Exclusions: Expressly disallows specified portions of the CPC from applying to Provincial Small Cause Courts.
- Immovable Property Limitation: Disables Small Cause Courts from executing decrees against immovable property, ordering its attachment, or appointing a receiver over it.
- No Injunction Powers: Prohibits issuance of temporary or interlocutory injunctions under Sections 94 and 95.
- Bar on Regular Appeals & CPC Revisions: Regular appeals (Sections 96-112) and CPC revision (Section 115) are excluded; remedies lie under Section 25 of the Provincial Small Cause Courts Act.
Practical Note
In practice before Small Cause Courts: (1) A Small Cause Court cannot execute its own decree against immovable property—the decree must be transmitted to a regular Civil Court under Section 39 for execution. (2) Small Cause Court judgments are non-appealable under the CPC (Sections 96–112 excluded); the sole remedy against an erroneous decree is a revision before the District Court/High Court under Section 25 of the Provincial Small Cause Courts Act, 1887.
