Plain English Summary

Section 67 empowers the State Government to frame rules regulating the execution sale of land or uncertain interests in land for satisfaction of money decrees, preserve or modify local pre-existing land sale rules, and mandates that all such rules be laid before the State Legislature.

Key Legal Elements

  • Rule-Making Power for Land Sales: Empowers State Governments to impose conditions on execution sales of uncertain landed interests.
  • Uncertain or Undetermined Interests: Applies specifically where value cannot be reliably appraised without special conditions.
  • Continuance & Modification of Local Rules (Sec 67(2)): Validates and continues special local land sale customs and enactments.
  • Legislative Oversight (Sec 67(3)): Obligates the executive to lay all framed rules before the State Legislature.

Practical Note

Protection of Agrarian Land Tenure & Subordinate Legislation: (1) Preventing Distress Undervaluation: Section 67 serves as an agrarian safeguard preventing predatory distress auctions of fragmented, occupancy, or customary land tenures whose market values are indeterminate. (2) Subordinate Legislation: Execution practitioners in states with customary land tenures (such as tribal areas, ryotwari holdings, or local tenancy acts) must consult local State Gazette notifications framed under Section 67, as they prevail over the standard auction mechanics of Order XXI.
