Library/CPC/Section 62
Section 62Procedural

Seizure of property in dwelling-house

Full Text

(1) No person executing any process under this Code directing or authorizing seizure of movable property shall enter any dwelling-house after sunset and before sunrise.

(2) No outer door of a dwelling-house shall be broken open unless such dwelling-house is in the occupancy of the judgment-debtor and he refuses or in any way prevents access thereto, but when the person executing any such process has duly gained access to any dwelling-house, he may break open the door of any room in which he has reason to believe any such property to be.

(3) Where a room in a dwelling-house is in the actual occupancy of a woman who, according to the customs of the country, does not appear in public, the person executing the process shall give notice to such woman that she is at liberty to withdraw; and, after allowing reasonable time for her to withdraw and giving her reasonable facility for withdrawing, he may enter such room for the purpose of seizing the property, using at the same time every precaution, consistent with these provisions, to prevent its clandestine removal.

Plain English Summary

Section 62 regulates the execution of warrants for the seizure of movable property inside dwelling-houses. It prohibits nocturnal entries between sunset and sunrise, restricts breaking open outer doors to situations where an occupying debtor actively prevents access, and mandates procedural safeguards to protect the privacy of pardanashin women.

Key Legal Elements

  • Nocturnal Immunity: Absolute ban against entering any dwelling-house for movable seizure after sunset and before sunrise.
  • Outer Door Inviolability: Outer doors cannot be broken open unless the debtor occupies the premises and actively refuses or obstructs access.
  • Inner Room Access: Once entry into the house is lawfully gained, the executing officer may break open inner rooms reasonably believed to contain attachable property.
  • Pardanashin Safeguard: Mandatory notice and reasonable facility for withdrawal to women observing purdah before entering their rooms, paired with precautions against clandestine removal.

Practical Note

Bailiff Attachment Limits, Tort of Trespass & Order XXI Rule 43: (1) Parallel with Section 55: Section 62 establishes identical privacy protections for property attachment as Section 55 does for civil arrest, preventing midnight harassment. (2) Strict Liability for Illegal Entry: An executing officer who breaches Section 62 (e.g., forcing entry before sunrise or breaking outer doors of a third party's home) commits actionable civil trespass and criminal house-trespass, invalidating the seizure. (3) Inner vs Outer Doors: Bailiffs cannot force the main entrance of an apartment or house unless debtor refusal is formally recorded; however, once inside lawfully, inner locked cupboards, almirahs, and interior room doors may be broken open if property is concealed therein.
