General power of transfer and withdrawal

(1) On the application of any of the parties and after notice to the parties and after hearing such of them as desired to be heard, or of its own motion without such notice, the High Court or the District Court may at any stage—

(a) transfer any suit, appeal or other proceeding pending before it for trial or disposal to any Court subordinate to it and competent to try or dispose of the same, or

(b) withdraw any suit, appeal or other proceeding pending in any Court subordinate to it, and—

(i) try or dispose of the same; or

(ii) transfer the same for trial or disposal to any Court subordinate to it and competent to try or dispose of the same; or

(iii) retransfer the same for trial or disposal to the Court from which it was withdrawn.

(2) Where any suit or proceeding has been transferred or withdrawn under sub-section (1), the Court which is thereafter to try or dispose of such suit or proceeding may, subject to any special directions in the case of an order of transfer, either retry it or proceed from the point at which it was transferred or withdrawn.

(3) For the purposes of this section,—

(a) Courts of Additional and Assistant Judges shall be deemed to be subordinate to the District Court;

(b) "proceeding" includes a proceeding for the execution of a decree or order.

(4) The Court trying any suit transferred or withdrawn under this section from a Court of Small Causes shall, for the purposes of such suit, be deemed to be a Court of Small Causes.

(5) A suit or proceeding may be transferred under this section from a Court which has no jurisdiction to try it.

It is also the principal vehicle for clubbing cross-suits or connected disputes pending before different judges into a single court to avoid conflicting judgments. Notice sub-section (5): Even if a suit was mistakenly filed in a court lacking territorial/pecuniary jurisdiction, Section 24(5) allows the High Court/District Court to directly transfer it to the competent court without requiring return and re-filing.

(1) पक्षकारों में से किसी के आवेदन पर और पक्षकारों को सूचना के पश्चात् तथा उनमें से जो सुने जाने की इच्छा रखते हैं उन्हें सुनने के पश्चात्, अथवा ऐसी सूचना के बिना स्वप्रेरणा से, उच्च न्यायालय या जिला न्यायालय किसी भी प्रक्रम पर—

(क) अपने समक्ष विचारण या निपटारे के लिए लम्बित किसी वाद, अपील या अन्य कार्यवाही को अपने अधीनस्थ और उसका विचारण या निपटारा करने के लिए सक्षम किसी न्यायालय को अन्तरित कर सकेगा; अथवा

(ख) अपने अधीनस्थ किसी न्यायालय में लम्बित किसी वाद, अपील या अन्य कार्यवाही को प्रत्याहृत (वापस मंगा) कर सकेगा, और—

(i) उसका विचारण या निपटारा स्वयं कर सकेगा; अथवा

(ii) उसे विचारण या निपटारे के लिए अपने अधीनस्थ और उसका विचारण या निपटारा करने के लिए सक्षम किसी न्यायालय को अन्तरित कर सकेगा; अथवा

(iii) उसे विचारण या निपटारे के लिए उसी न्यायालय को पुनः अन्तरित कर सकेगा जिससे वह प्रत्याहृत की गई थी।

(2) जहां कि कोई वाद या कार्यवाही उपधारा (1) के अधीन अन्तरित या प्रत्याहृत की गई है, वहां वह न्यायालय जिसे तत्पश्चात् ऐसे वाद या कार्यवाही का विचारण या निपटारा करना है, अन्तरण के आदेश की दशा में किन्हीं विशेष निदेशों के अध्यधीन रहते हुए, या तो उसका पुनः विचारण कर सकेगा या उस प्रक्रम से आगे कार्यवाही कर सकेगा जिस पर वह अन्तरित या प्रत्याहृत की गई थी।

(3) इस धारा के प्रयोजनों के लिए,—

(क) अपर और सहायक न्यायाधीशों के न्यायालय जिला न्यायालय के अधीनस्थ समझे जाएंगे;

(ख) "कार्यवाही" के अन्तर्गत डिक्री या आदेश के निष्पादन की कार्यवाही आती है।

(4) किसी लघुवाद न्यायालय से इस धारा के अधीन अन्तरित या प्रत्याहृत किसी वाद का विचारण करने वाला न्यायालय, ऐसे वाद के प्रयोजनों के लिए, लघुवाद न्यायालय समझा जाएगा।

(5) इस धारा के अधीन किसी वाद या कार्यवाही का अन्तरण ऐसे न्यायालय से भी किया जा सकेगा जिसे उसके विचारण की अधिकारिता नहीं है।
