Explanation.—In this section "property" means property situate in India.
Plain English Summary
Section 16 governs territorial jurisdiction for immovable property, mandating that suits for recovery, partition, mortgage foreclosure/redemption, determination of rights, or damage to land must be filed where the property is situated. The proviso permits filing where the defendant resides if relief can be obtained entirely through their personal obedience.
Key Legal Elements
- Doctrine of Lex Situs: Actions in rem or affecting title/possession of immovable property must be filed where the property is situated.
- Scope of Clause (a)-(f): Encompasses possession, partition, mortgage foreclosure/sale/redemption, title determination, torts to land, and attached movables.
- Proviso (Equity in Personam): Permits filing where defendant resides/works if relief can be completely satisfied through defendant's personal obedience.
- Territorial Boundary: The explanation clarifies that 'property' denotes property located within India.
Practical Note
Strategic invocation of Section 16 vs. Proviso: Suits for partition, recovery of possession, or declaration of title MUST strictly be filed in the court where the immovable property is situate. However, under the Proviso, an action for specific performance of a contract of sale of land (where delivery of possession is not claimed) or for accounts/rescission can be instituted where the defendant resides/carries on business, because the decree can be satisfied through the defendant's personal act of signing the deed.
