Library/CPC/Section 157
Section 157Procedural

Continuance of orders under repealed enactments

Full Text

Notifications published, declarations and rules made, places appointed, agreements filed, scales prescribed, forms framed, appointments made and powers conferred under Act VIII of 1859 or under any Code of Civil Procedure or any Act amending the same or under any other enactment hereby repealed shall, so far as they are consistent with this Code, have the same force and effect as if they had been respectively published, made, appointed, filed, prescribed, framed and conferred under this Code and by the authority empowered thereby in such behalf.

Plain English Summary

Section 157 preserves legal continuity upon the commencement of the 1908 Code, establishing that all subordinate notifications, rules, appointments, forms, and delegated powers promulgated under earlier repealed Civil Procedure Codes remain fully effective and binding, provided they are not inconsistent with this Code.

Key Legal Elements

  • Continuance of Delegated Actions: Preserves notifications, rules, forms, scales, appointments, and powers under repealed civil codes (Act VIII of 1859, Code of 1882).
  • Consistency Requirement: Retains force and effect only so far as they are consistent with the provisions of the 1908 Code.
  • Legal Fiction: Deemed to have been made, published, and conferred under the 1908 Code by the competent statutory authority.

Practical Note

Statutory Savings & Subordinate Legislation Continuity (Section 24 General Clauses Act): 1. Preservation of Existing Rules & Notifications: Section 157 operates in harmony with Section 24 of the General Clauses Act, 1897. When the 1908 Code replaced the 1882 Code, hundreds of subordinate notifications (such as court fee scales, local court sittings, appointment of ministerial officers, and local civil rules) were preserved without needing immediate re-promulgation. 2. Consistency Test: The only statutory test is consistency with the 1908 Code. Any pre-existing colonial rule or notification that directly contradicts the substantive text of the 1908 Code lapses automatically.
