Transfer of business
Full Text
Save as otherwise provided, where the business of any Court is transferred to any other Court, the Court to which the business is so transferred shall have the same powers and shall perform the same duties as those respectively conferred and imposed by or under this Code upon the Court from which the business was so transferred.
Plain English Summary
Section 150 provides for institutional continuity upon the administrative re-allocation or territorial transfer of court business, vesting the transferee court with all the procedural powers and duties previously possessed by the transferor court.
Key Legal Elements
- Institutional Continuity: Automatically transfers all statutory powers and duties from the transferor court to the transferee court.
- Broad Administrative Scope: Applies when judicial territories are reorganized, new courts created, or rosters transferred by administrative orders.
- Execution Competence: Enables the transferee court to entertain execution petitions and interlocutory applications without a formal Section 39 transfer certificate.
Practical Note
Territorial Reorganization and Transfer of Execution Competence: 1. Meaning of 'Transfer of Business': Section 150 applies to administrative transfers of judicial work from one court to another (e.g. when a new Civil Judge or District Judge court is constituted and pending files or territorial areas are transferred to it by the High Court or District Judge). 2. Jurisdiction to Execute Decrees: As established in Ramier v. Muthukrishna Ayyar (AIR 1932 Mad 418 FB), when a court's territorial jurisdiction or pending cases are transferred to a new court under Section 150, the new court has the inherent power to entertain execution petitions directly, without requiring a formal transfer precept or non-satisfaction certificate under Section 39.
