The procedure provided in this Code in regard to suits shall be followed, as far as it can be made applicable, in all proceedings in any Court of civil jurisdiction.

Explanation.—In this section, the expression “proceedings” includes proceedings under Order IX, but does not include any proceedings under article 226 of the Constitution.

Foundation of Miscellaneous Civil Practice: Section 141 ensures that civil courts need not invent separate procedures for miscellaneous petitions (such as probate, succession certificates, guardian appointments, arbitration petitions, or pauper applications). Suit provisions (pleadings, discovery, evidence, amendments, abatement) apply mutatis mutandis. 2. Order IX Applications Covered: The Explanation codifies the landmark Supreme Court ruling in Nathu Prasad v. Singhai Kapurchand (AIR 1976 SC 1384): if an Order IX application (to restore a suit or set aside an ex-parte decree) is itself dismissed for default, another application under Order IX Rule 9 read with Section 141 lies to restore that application! 3. Exclusion of Writ Proceedings (Article 226): As affirmed in State of U.P. v. Nawab Hussain (1977) and Babubhai Muljibhai Patel v. Nandlal Khodidas Barot (1974), the procedural technicalities of the CPC do not strictly bind High Courts exercising extraordinary writ jurisdiction under Article 226, preserving flexible summary constitutional adjudication. 4. Execution Proceedings Excluded: As held in Dokku Bhushayya v. Katragadda Ramakrishnan Rao (AIR 1962 SC 1886), Section 141 does not extend suit procedures to execution proceedings under Order XXI, which are self-contained.
