Procedure where person to be arrested or property to be attached is outside district

(1) Where an application is made that any person shall be arrested or that any property shall be attached under any provision of this Code not relating to the execution of decrees, and such person resides or such property is situate outside the local limits of the jurisdiction of the Court to which the application is made, the Court may, in its discretion, issue a warrant of arrest or make an order of attachment, and send to the District Court within the local limits of whose jurisdiction such person or property resides or is situate a copy of the warrant or order, together with the probable amount of the costs of the arrest or attachment.

(2) The District Court shall, on receipt of such copy and amount, cause the arrest or attachment to be made by its own officers, or by a Court subordinate to itself, and shall inform the Court which issued or made such warrant or order of the arrest or attachment.

(3) The Court making an arrest under this section shall send the person arrested to the Court by which the warrant of arrest was issued, unless he shows cause to the satisfaction of the former Court why he should not be sent to the latter Court, or unless he furnishes sufficient security for his appearance before the latter Court or for satisfying any decree that may be passed against him by that Court, in either of which cases the Court making the arrest shall release him.

(4) Where a person to be arrested or movable property to be attached under this section is within the local limits of the ordinary original civil jurisdiction of the High Court of Judicature at Fort William in Bengal or at Madras or at Bombay, the copy of the warrant of arrest or of the order of attachment, and the probable amount of the costs of the arrest or attachment, shall be sent to the Court of Small Causes of Calcutta, Madras or Bombay, as the case may be, and that Court, on receipt of the copy and amount, shall proceed as if it were the District Court.

Pre-Decree vs Post-Decree Executions: Section 136 governs interlocutory processes NOT relating to decree execution (e.g. Order XXXVIII Rule 1 arrest before judgment, Order XXXVIII Rule 5 attachment before judgment, or witness arrest under Section 32). In contrast, post-decree executions across districts are governed by Sections 38 to 46 (transfer of decrees) and Order XXI. 2. Direct Attachment Void Without Transferee Court: A trial court cannot directly dispatch its own bailiff to attach immovable or movable property located in another district or state. The order must be routed through the concerned District Court under Section 136; direct execution without following Section 136 renders the attachment illegal and void. 3. Release on Security (Sub-section 3): An arrested defendant need not be transported across state/district lines if he furnishes sufficient security before the local arresting court to appear or satisfy the decree, or satisfies that court on show cause.

(1) जहां यह आवेदन किया जाता है कि इस संहिता के डिक्रियों के निष्पादन से असंबंधित किसी उपबंध के अधीन किसी व्यक्ति को गिरफ्तार किया जाए या किसी संपत्ति को कुर्क किया जाए, और ऐसा व्यक्ति उस न्यायालय की अधिकारिता की स्थानीय सीमाओं के बाहर निवास करता है या ऐसी संपत्ति बाहर स्थित है जिससे आवेदन किया गया है, वहां वह न्यायालय, स्वविवेकानुसार, गिरफ्तारी का वारंट जारी कर सकेगा या कुर्की का आदेश कर सकेगा, तथा उस जिला न्यायालय को, जिसकी अधिकारिता की स्थानीय सीमाओं के भीतर ऐसा व्यक्ति निवास करता है या ऐसी संपत्ति स्थित है, वारंट या आदेश की एक प्रति, गिरफ्तारी या कुर्की के संभावित खर्चों की राशि के साथ, भेजेगा।

(2) जिला न्यायालय, ऐसी प्रति और राशि प्राप्त होने पर, अपने अधिकारियों द्वारा या अपने अधीनस्थ किसी न्यायालय द्वारा गिरफ्तारी या कुर्की करवाएगा, और जिस न्यायालय ने ऐसा वारंट या आदेश जारी किया था उसे ऐसी गिरफ्तारी या कुर्की की सूचना देगा।

(3) इस धारा के अधीन गिरफ्तारी करने वाला न्यायालय गिरफ्तार किए गए व्यक्ति को उस न्यायालय के पास भेजेगा जिसके द्वारा गिरफ्तारी का वारंट जारी किया गया था, जब तक कि वह पूर्वोक्त न्यायालय के समाधानप्रद रूप में यह कारण दर्शित न कर दे कि उसे पश्चातवर्ती न्यायालय के पास क्यों न भेजा जाए, अथवा जब तक कि वह पश्चातवर्ती न्यायालय के समक्ष अपनी उपसंजाति के लिए या उस न्यायालय द्वारा उसके विरुद्ध पारित की जाने वाली किसी डिक्री की तुष्टि के लिए पर्याप्त प्रतिभूति (Security) न दे दे, और इन दोनों में से किसी भी दशा में गिरफ्तारी करने वाला न्यायालय उसे छोड़ देगा।

(4) जहां इस धारा के अधीन गिरफ्तार किया जाने वाला व्यक्ति या कुर्क की जाने वाली जंगम संपत्ति फोर्ट विलियम (बंगाल), मद्रास या बंबई स्थित उच्च न्यायालय की मामूली आरंभिक सिविल अधिकारिता की स्थानीय सीमाओं के भीतर है, वहां गिरफ्तारी के वारंट या कुर्की के आदेश की प्रति, और संभावित खर्चों की राशि, यथास्थिति, कलकत्ता, मद्रास या बंबई के लघुवाद न्यायालय (Court of Small Causes) को भेजी जाएगी, और वह न्यायालय ऐसे अग्रसर होगा मानो वह जिला न्यायालय हो।
