Full Text
(1) Nothing contained in this Code shall be deemed—
(a) to affect the powers of the Supreme Court under article 136 or any other provision of the Constitution; or
(b) to interfere with any rules made by the Supreme Court, and for the time being in force for the presentation of appeals to that Court, or their conduct before that Court.
(2) Nothing herein contained applies to any matter of criminal or admiralty or vice-admiralty jurisdiction or to appeals from orders and decrees of Prize Courts.

Primacy of Article 136 & Inherent Plenary Jurisdiction: (1) Inviolable Article 136: Section 112(1)(a) explicitly acknowledges that no provision of the Code of Civil Procedure (including Section 100A bar on LPA or Section 102 monetary bar or Section 104(2) bar on second appeal from orders) can curtail, fetter, or restrict the plenary constitutional jurisdiction of the Supreme Court under Article 136. Even where the High Court refuses a certificate under Section 109, the aggrieved party has an unfettered constitutional right to petition the Supreme Court for Special Leave (*Durga Shankar Mehta v. Raghuraj Singh, 1954*). (2) Supreme Court Rules 2013: Sub-section (1)(b) ensures that the Supreme Court Rules framed under Article 145 prevail over the First Schedule of CPC regarding filing, limitation, paper books, and conduct of civil appeals before the Apex Court.

(1) इस संहिता में की कोई भी बात—
(क) संविधान के अनुच्छेद 136 या किसी अन्य उपबंध के अधीन उच्चतम न्यायालय की शक्तियों को प्रभावित करने वाली; अथवा
(ख) उस न्यायालय में अपीलों के उपस्थापन के लिए या उस न्यायालय के समक्ष उनके संचालन के लिए उच्चतम न्यायालय द्वारा बनाए गए और तत्समय प्रवृत्त किन्हीं नियमों में हस्तक्षेप करने वाली,
नहीं समझी जाएगी।
(2) इसमें अंतर्विष्ट कोई भी बात दांडिक (criminal) या नावधिकरण (admiralty) या उप-नावधिकरण अधिकारिता के किसी मामले को अथवा प्राइज न्यायालयों (Prize Courts) के आदेशों और डिक्रियों से अपीलों को लागू नहीं होगी।
