Section 108Procedural

Procedure in appeals from appellate decrees and orders

Full Text

The provisions of this Part relating to appeals from original decrees shall, so far as may be, apply to appeals—

(a) from appellate decrees, and

(b) from orders made under this Code or under any special or local law in which a different procedure is not provided.

Plain English Summary

Section 108 applies the procedural provisions governing First Appeals (from original decrees) mutatis mutandis to Second Appeals (from appellate decrees) and Miscellaneous Appeals (from orders under CPC or special/local laws), ensuring procedural uniformity.

Key Legal Elements

  • Mutatis Mutandis Extension: Extends First Appeal rules and procedures to Second Appeals and Appeals from Orders.
  • Uniformity of Appellate Practice: Regulates memorandum format, stay applications, cross-objections, and hearing procedure.
  • Integration with Special/Local Laws: Fills procedural gaps for statutory appeals created under special or local enactments.

Practical Note

Mutatis Mutandis Application Across Appellate Hierarchy: (1) Bridging First Appeals to Second Appeals & Orders: Section 108 serves as an interpretive bridge; procedural safeguards applicable to First Appeals (e.g., limitation, stay of execution under Order XLI Rule 5, dismissal for default and restoration under Rules 17 & 19, cross-objections under Rule 22) automatically apply to Second Appeals (Order XLII) and Appeals from Orders (Order XLIII). (2) Special & Local Laws: Where a special enactment (e.g. Rent Control Act, Land Acquisition, or Motor Vehicles Act) provides for an appeal to a civil court but is silent on the internal procedure, Section 108 imports the general CPC appellate provisions.
