Burden of proof as to relationship in the cases of partners, landlord and tenant, principal and agent
Full Text
When the question is whether persons are partners, landlord and tenant, or principal and agent, and it has been shown that they have been acting as such, the burden of proving that they do not stand, or have ceased to stand, to each other in those relationships respectively, is on the person who affirms it.
Plain English Summary
Once a relationship of partnership, tenancy, or agency is shown to exist by the parties' actions, the burden of proving that the relationship has ended lies on the person claiming so.
Key Legal Elements
- Question of relationship (Partners, Landlord-Tenant, Principal-Agent)
- Proof that they have been acting as such
- Burden shifts to the person denying the current status of the relationship
Practical Note
This section deals with the 'presumption of continuity'. It is vital in civil litigation involving property disputes or business liability where one party claims a contract or relationship has expired.
