Form of warrant of arrest and duration

Full Text

72. Form of warrant of arrest and duration.—(1) Every warrant of arrest issued by a Court under this Sanhita shall be in writing, signed by the presiding officer of such Court and shall bear the seal of the Court.

(2) Every such warrant shall remain in force until it is cancelled by the Court which issued it, or until it is executed.

Plain English Summary

Defines the legal form of an arrest warrant—written, signed, and sealed—and establishes that it remains valid until executed or officially cancelled.

Key Legal Elements

  • Mandatory written format for warrants
  • Requirement for presiding officer signature
  • Indefinite validity until execution or cancellation
  • Mandatory Court seal

Practical Note

Unlike a summons, a warrant does not expire by mere passage of time; once issued, it stays 'live' in the system until the person is caught or the court withdraws it.
