Section 520Procedural

Trials before High Courts

Full Text

When an offence is tried by the High Court otherwise than under section 447, it shall, in the trial of the offence, observe the same procedure as a Court of Sessions would observe if it were trying the case.

Plain English Summary

Directs the High Court to follow the Sessions Court trial procedure when it directly conducts a trial.

Key Legal Elements

  • High Court original jurisdiction
  • Adherence to Sessions trial procedure
  • Exceptions under Section 447

Practical Note

Ensures procedural consistency. Even if the highest court of a state tries a case, the standard protection and steps of a Sessions trial must be maintained.
