Section 5Procedural

Saving

Full Text

5. Nothing contained in this Sanhita shall, in the absence of a specific provision to the contrary, affect any special or local law for the time being in force, or any special jurisdiction or power conferred, or any special form of procedure prescribed, by any other law for the time being in force.

Plain English Summary

A 'saving clause' that ensures that the Sanhita does not override existing special or local laws unless specifically stated.

Key Legal Elements

  • Protects special and local laws from being automatically overridden
  • Preserves special jurisdictions or powers conferred by other laws
  • Applies unless there is a specific provision to the contrary

Practical Note

If a special law (like the NDPS Act) has a specific procedure, that procedure will prevail over the general rules in the BNSS.
