Power to commute sentence

The appropriate Government may, without the consent of the person sentenced, commute—

(a) a sentence of death, for imprisonment for life;

(b) a sentence of imprisonment for life, for imprisonment for a term not less than seven years;

(c) a sentence of imprisonment for seven years or more, for imprisonment for a term not less than three years;

(d) a sentence of imprisonment for less than seven years, for fine;

(e) a sentence of rigorous imprisonment, for simple imprisonment for any term to which that person might have been sentenced.

समुचित सरकार, दंडादेश प्राप्त व्यक्ति की सहमति के बिना, निम्नलिखित का लघुकरण कर सकती है—

(a) मृत्यु दंडादेश को आजीवन कारावास में ;

(b) आजीवन कारावास को ऐसी अवधि के कारावास में जो सात वर्ष से कम न हो ;

(c) सात वर्ष या उससे अधिक के कारावास को ऐसी अवधि के कारावास में जो तीन वर्ष से कम न हो ;

(d) सात वर्ष से कम के कारावास को जुर्माने में ;

(e) कठोर कारावास को साधारण कारावास में उस किसी अवधि के लिए जिसके लिए उस व्यक्ति को दंडादेश दिया जा सकता था।
