Plain English Summary
Mandates that any death sentence passed by a Court of Session must be confirmed by the High Court before it can be executed.
Key Legal Elements
- Mandatory High Court confirmation for death sentences
- Proceedings must be submitted 'forthwith'
- Accused remains in jail custody pending confirmation
- Execution stayed until High Court decision
Punishment
Death sentence (subject to High Court confirmation).
Practical Note
This is one of the most important safeguards in criminal law. A death sentence is not final upon the verdict of the Trial Court; the High Court must independently re-examine the case in a 'Confirmation Reference'.
