Section 252Procedural

Conviction on plea of guilty

Full Text

If the accused pleads guilty, the Judge shall record the plea and may, in his discretion, convict him thereon.

Plain English Summary

Provides for the possibility of immediate conviction if an accused person chooses to plead guilty, at the Judge's discretion.

Key Legal Elements

  • Judge records the plea of guilty if made by the accused
  • Judge has discretion to convict based on the plea
  • Conviction is not mandatory; Judge can still proceed with trial if needed

Practical Note

This allows for a swift conclusion of the case if the accused admits guilt. However, the Judge is not bound to convict; they must ensure the plea is voluntary and clear, especially in serious offences.
