Section 199PopularProcedural

Offence triable where act is done or consequence ensues

Full Text

When an act is an offence by reason of anything which has been done and of a consequence which has ensued, the offence may be inquired into or tried by a Court within whose local jurisdiction such thing has been done or such consequence has ensued.

Plain English Summary

Grants jurisdiction to Courts where either the criminal act occurred or where the results of that act took place.

Key Legal Elements

  • Jurisdiction at place of criminal act
  • Jurisdiction at place of consequence
  • Concurrent jurisdiction for act-and-result offences

Punishment

Jurisdiction based on act and consequence.

Practical Note

Classic example: If a person is shot in District A but dies in a hospital in District B, both Districts have jurisdiction to try the culprit. This ensures that the location of death or injury is as legally significant as the location of the act.
