Dispute concerning right of use of land or water

(1) Whenever an Executive Magistrate is satisfied from a report of a police officer or upon other information that a dispute likely to cause a breach of the peace exists regarding any alleged right of user of any land or water within his local jurisdiction, he shall make an order in writing and requiring the parties concerned to attend his Court and put in written statements of their claims.
(3) If it appears to the Magistrate that such rights exist, he may make an order prohibiting any interference with the exercise of such right, including the removal of any obstruction: Provided that no such order shall be made unless such right has been exercised within three months (for year-round rights) or during the last season (for seasonal rights) before the report.
(4) The Magistrate can switch the proceedings to Section 164 if they find the dispute should be dealt with under that section, and vice-versa.

(1) यदि मजिस्ट्रेट को लगता है कि जमीन या पानी के उपयोग के अधिकार (जैसे रास्ते का अधिकार या सुखाचार) से जुड़े विवाद से शांति भंग हो सकती है, तो वह पक्षों को अपने दावे पेश करने का आदेश दे सकता है।
(3) यदि अधिकार मौजूद है, तो मजिस्ट्रेट हस्तक्षेप को रोक सकता है और बाधाओं को हटाने का आदेश भी दे सकता है। शर्त: अधिकार का प्रयोग पिछले 3 महीनों के भीतर (सालाना अधिकारों के लिए) या पिछले सीजन (मौसमी अधिकारों के लिए) के दौरान किया गया होना चाहिए।
