Sexual intercourse by person in authority.

Whoever, being—\n(a) in a position of authority or in a fiduciary relationship; or\n(b) a public servant; or\n(c) on the management or on the staff of a jail, remand home or other place of custody or of a women's or children's institution; or\n(d) on the management or on the staff of a hospital,\nabuses such position or fiduciary relationship to induce or seduce any woman in his charge or present in his premises to have sexual intercourse with him, such sexual intercourse not amounting to the offence of rape, shall be punished with rigorous imprisonment for a term which shall not be less than five years, but which may extend to ten years, and shall also be liable to fine.

प्राधिकारवान व्यक्ति द्वारा मैथुन।\nजो कोई—\n(क) प्राधिकार की स्थिति में या वैश्वासिक संबंध में होते हुए ; या\n(ख) लोक सेवक होते हुए ; या\n(ग) किसी जेल, सुधार गृह या अभिरक्षा के अन्य स्थान या स्त्री या बाल संस्था के प्रबंध या कर्मचारी वृन्द में होते हुए ; या\n(घ) किसी अस्पताल के प्रबंध या कर्मचारी वृन्द में होते हुए,\nऐसी स्थिति या वैश्वासिक संबंध का दुरुपयोग अपनी देख-रेख में या अपने परिसर में उपस्थित किसी स्त्री को अपने साथ मैथुन करने के लिए उत्प्रेरित या लुभाने के लिए करेगा, और ऐसा मैथुन बलात्संग के अपराध की कोटि में नहीं आता है, तो वह कठिन कारावास से, जिसकी अवधि पाँच वर्ष से कम नहीं होगी किन्तु जो दस वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने से भी दंडनीय होगा ।
