Mischief by killing, poisoning, maiming or rendering useless any animal

Full Text

Whoever commits mischief by killing, poisoning, maiming or rendering useless any animal shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.

Plain English Summary

Punishes mischief committed against animals, including killing, poisoning, maiming, or rendering them useless, with up to five years imprisonment.

Key Legal Elements

  • Commission of mischief
  • Mischief is directed against any animal (defined as any living creature other than humans)
  • Actions include killing, poisoning, maiming, or rendering the animal useless
  • Requires intent or knowledge that such action causes harm or loss

Punishment

Imprisonment up to 5 years, or fine, or both

Practical Note

CRITICAL COMPARISON: BNS Section 325 consolidates and replaces IPC Sections 428 and 429. While the IPC set different thresholds based on the value of the animal (IPC 428 applied to animals worth ₹10 or more, and IPC 429 applied to cattle/elephants/camels or any animal worth ₹50 or more), the BNS eliminates these value-based distinctions to provide uniform, strong protection for all animals. Note that IPC Section 325 (punishment for voluntarily causing grievous hurt) has been renumbered to BNS Section 117(2), which is bailable.
